I am following up with you since we have not received your response. Further, the check for $225,000.00 that was mailed to you as part of your inheritance distribution from the Estates is now void because it had not been cashed. We will have a new check available for you when you arrive to retrieve your portion of the personal property distribution from the estate. Due to the sale of the residence, the personal property has been moved to a storage unit. Regarding the personal property that is being distributed to you, please reply with your choice of a day from July 12-16 starting at 9:00 a.m. that you would like to meet at the storage unit facility to pick up items that you would like from the Estates. Please reply as soon as you can so we can plan, accordingly. We will then meet you at the Storage Unit with a key for access to the contents. Whatever you leave behind will be your consent and agreement that such property will either be taken by Neila, donated or disposed of so that the Storage Unit will no longer be kept. If you fail to respond before July 12, 2022, we will have no choice but to otherwise dispose of the personal property. Please provide your phone number for our file and further communication. I am following up with you to confirm you received the letter attached and the check for $225,000.00 that was mailed to you as part of your inheritance distribution from the Estates. Please reply confirming your receipt of the same. Regarding the personal property that is being distributed to you, can you choose a day from May 27th - May 29th that you would like to meet at the Xxxxxxx residence to pick up items that you would like from the Estates. You may arrive and begin as early as 8:00 a.m. on any of these days, just reply letting us know what day works best for you so we can plan, accordingly. (Movers and inventory details from above repeated) I replied within the hour: From: Me Sent: Thursday 06/30/2022 8:04 PM Dear Ms. Wright, Thank you for your email. I did not receive any email from you in May or at all before today and don't have a spam folder, so everything gets through. I don't doubt that you sent it, but it apparently did not complete its journey. I no longer live in Dallas full time and was not aware of the check until well after it arrived unannounced. My apologies for any inconvenience this caused. I'm not interested in most of said contents, but would like a few things and should have some photos and such to send the other way. July 12 at 0900 will be fine. A couple of questions - will I be able to operate at leisure that day at the storage unit, make multiple trips, take breaks if needed, etc.? I'm dealing with a serious medical matter and am badly compromised, so how things are paced is of concern. Thank you. From: Kimmy Wright Sent 7/1/2022, 3:27 PM Dear Mr. Xxxxxx, Thank you for your message. I understand and I believe you would have access to that Storage Unit on July 12, 2022, from 9:00 a.m. until 7:00 p.m. that same day. Do bring others to assist you, as needed. Please do send a list and/or photos of the items you mentioned wanting. I believe it will assist us for that day. Please reply to this email confirming July 12, 2022 at 9:00 a.m. for meeting at the Storage Unit and so that I know you received it. Thank you. From: Me Sent 7/8/2022, 5:53 AM Good morning, Ms. Wright, I consulted with one of my clinicians yesterday about this matter and we both grew quite concerned. I'm fighting to recover from an unexpected medical situation one could call grave. The task at the storage unit is substantial and the weather will be dangerously oppressive. Rationality insists I have access for more than 10 sweltering hours on a single grueling day. I request in the most serious manner that I have access for longer, especially early when it's not as hot. Access during the entire initial range of July 12-16 you mentioned would be much less dangerous to me. Surely you don't want to needlessly subject an aging, ill, handicapped person to such onerous demands as originally outlined. Of course you don't. It is my longstanding policy to never, ever leave Public Storage in an ambulance. I await your reply and revision of the plan. Thank you, From: Kimmy Wright Sent 7/8/2022, 3:37 PM Good afternoon. Based on the information you provided in your emails and for your safety, we are going to need to reschedule the meeting at the storage unit. The items that you specifically requested in your email will be moved to a Public Storage unit that is on the interior of the building, has climate control, and an elevator. All furniture, bed mattresses, washer, dryer, refrigerator, the organ, clothing of mom and dad, lamps that you indicated in your email you were not interested in will not be moved to the new interior storage unit. They will be disposed of as there is no need to continue to store them. We will reach out to you with other dates/times for your access and retrieval of these items as soon as the relocation of the items has occurred. Have a good weekend. From: Me Sent 7/8/2022, 4:31 PM Dear Kimmy, Thank you for your understanding. I will be out of the country for much of the rest of the summer after next week, so it's either next week or considerably later. Should the latter, later option be the ticket, please FedEx me another check to arrive before Friday, July 15. Regardless of when this is done, having more than one day to tend to it is of significant importance. When it's time for me to stop, it's quite seriously time to stop and predicting how it pans out has proven challenging. A bit of flexibility is most helpful and appreciated. You, too, have a nice weekend. From: Kimmy Wright Sent 7/15/2022, 9:51 AM Good morning. I have confirmed with Ms. Flozberk that the storage unit will be available to you the week of August 8-12. As soon as the new storage unit is secured, we will provide you the new information. A key to the Unit will be available at our office for you to retrieve and then return after you remove the items and before the end of August 12. Please also reply here to confirm you receipt of the check that was sent via FedEx to you. Thank you. From: Kimmy Wright Sent 8/5/2022, 5:46 PM Dear Mr. Xxxxxx, Following is the information and instructions for your retrieval of items next week: You will need the Keys and Access Cards to the Public Storage Units. They are at our with our Receptionist in our office located at the address below. Our office is open M-F from 9:00 a.m. – 5:00 p.m. The storage units are located at PUBLIC STORAGE, 5342 E. Mockingbird Ln., Dallas, TX: There are 2 units at Public Storage due to not having enough room in the first unit. Ms. Flozberk separated most of the garage items in Unit #A2377 and the other household items your requested in Unit #A2133. These Units will be available to you from August 8-12, 2022. Attached are the access codes, bank statement with invoices, and the Public Storage agreement for your reference. The Code is to get into the Gate and to open the building doors. (Use the Gate closest to 75 Central.) The Keys are to the Units. Please note that the 2 folding tables in Unit #A2133 are there for your use only and should be left in the Units when you leave. Please return the Keys and Access Cards to our office before 5:00 p.m. on August 12, 2022. Do let us know if you have any questions. Thank you. From: Me Sent 8/8/2022, 10:27 AM I have returned to the USA and the items will be picked up from your office later today. I'm not feeling very well, so an agent of mine will likely do the deed. The agent will have a printout of your email. I trust this will not be a problem. Regards, From: Kimmy Wright Sent 8/8/2022, 11:21 AM Thank you for your message and the information. Please reply with your agent’s name. We will ask for their Driver’s License upon their arrival to confirm identity. We will also be asking them to sign for receipt of the keys, etc. Thank you. From: Me 8/8/2022, 11:44 PM Dear Kimmy, The agent will be one of several people including me - I'm dealing with the logistics now. Said agent will gladly provide ID and a signature. That really should suffice. Thank you, From: Me Sent 8/11/2022, 7:40 AM Dear Kimmy, Good morning. Tending to the storage units' contents is well underway and is even more taxing than I'd estimated. The climate control at the larger unit is, well, marginal at best. So goes life. Will it cause any woe to extend this matter until Sunday or Monday? Both members of my household are seriously and permanently disabled and we are being pushed to the limit. Additional help is being brought in today, but there's only so much that can get done each day and it's bordering on overwhelming. It is possible, and indeed preferable to me that we be done by Friday afternoon but it simply may not be practicable. I must note that the original proposed terms regarding this matter (again, I never received the alleged May 2022 notification) - "please reply with your choice of a day from July 12-16 starting at 9:00 a.m. that you would like to meet at the storage unit facility to pick up items that you would like" - can only be described as horrific. From that starkly unreasonable request to a six figure check sitting on my porch for weeks while we were away to even the attempt last Monday to pick up the keys to the storage units, this has been something of a fiasco. Let's try and close this part of the affair on a higher note, eh? I can update you on progress later today if you'd like. Cheers. From: Me Sent 8/12/2022, 8:44 AM Dear Kimmy, Good morning. Today we will attempt to complete the process, but it seems impossible to do so before 1700h. A few details: - The temperature in the block containing the #2133 unit was actually higher than the outside temperature yesterday. The neighboring block, not part of this, was much cooler and the #2377 block was a bit cooler, but not much. One of my helpers, a martial arts expert and former piano mover was almost laid out after a short time at #2377. We will manage, but it's been brutal. - It is inherently time-consuming to thoughtfully sort through through a half century of life under those brutal conditions. Without due care, much will be lost. This is exemplified by our finding an 8mm film of my parents' wedding at the bottom of one of the boxes. This one is quite self-explanatory, yet far from the worst related to my situation. I'll not bore you with the details, but in the last several months I've had 5 surgeries, a fight for survival, and generated about $400,000 in medical costs. Those circumstances are certainly not speeding things up and I simply cannot exceed the limits imposed by my health. Know that I am pushing it hard, though. Therefore, while we will strive to complete the task by 1700 today, I find that unlikely. The keys will be returned to your office by 1000h Monday, August 15. That will leave much more time to complete the matter than the proposed several hours that were offered to me to go through, under positively dreadful conditions, a half century of life. Fair enough? You bet it is. Regards. From: Kimmy Wright Sent 8/12/2022, 10:01 AM Thank you for your messages. You may keep access to the Units until Monday, August 15th with return of the keys to our office before 5:00 p.m. It was our understanding that you would be moving all of the contents out of the Units and nothing would be left in the Units afterward except the 2 folding tables. It appears you are sorting through the contents in the Units onsite and that you may not be taking all of the contents offsite which will result in additional costs for cleaning out the remainders from the Units. Seems you would be much more comfortable sorting in the comfort of your home at your leisure. We never intended that you would do so in the Units. Please note that we have received Reprimand Notice from the Storage Facility Management regarding you overstaying their Access Hours and exiting the gate after 9:00 p.m. You must be completely offsite of the Storage Facility (out of the Gates) by 9:00 p.m. Please comply with the posted Access Hours. Gate Access Hours: Mon-Fri: 6:00 AM - 9:00 PM, Sat-Sun: 6:00 AM - 9:00 PM We will have one other box of a few items for you that Ms. Flozberk felt were too precious to leave in the Units. It will be in our office Monday, August 15th after 9:00 a.m. for you. Thank you. From: Me Sent 8/15/2022, 6:26 AM Dear Kimmy, We've reached that point in which numeration is in order: 1. Uh, mercy! *FACEPALM* *SMH* 2. There was precisely a zero-point-zero percent chance that I would have taken all of those ludicrously-packed items. Merely thinking about it is dizzying, Had such a fanciful notion been floated, I would have sunk it on the spot. 3. There was precisely zero indication that I was expected to move all of the contents from the units. If I somehow missed such a thing, my apologies, but that doesn't seem to be the case. If I'm mistaken, kindly indicate when it was conveyed. It strongly appears you neglected to do so. 4. There is precisely zero reason I should have assumed the conditions would change in August vs. July. Behold this review of the Pubic Storage phase of this increasingly-interesting odyssey: June 30 you wrote: please reply with your choice of a day from July 12-16 starting at 9:00 a.m. that you would like to meet at the storage unit facility to pick up items that you would like from the Estates. 5. Nothing in any subsequent communication I've received contradicts that June 30 advisory. The only changes were that 1) the time span was broadened from that barbaric one business day limit to a merely-daunting five days and 2) the key transfer moved from onsite to your office. 5. "Items that I would like" implies an onsite selection process that is badly at odds with your "We never intended that you would do so in the Units [sic]" claim. I've no affinity for mystery content banker's boxes or storage bins haphazardly stuffed with junk. 6. "Whatever you leave behind" would seem to imply a quantity in excess of "nothing." 7. How is it possible to identify items that I "would like" from the units and engender a condition in which things left behind "will either be taken by Neila, donated, or disposed of" without onsite sorting? 8. Had your client "donated," as indicated above, this now-expected "nothing," the donee(s) likely would have been rather disappointed. 9. So, uh....what did I miss??? What on Earth is going on here, Counselor? I've heard multiple good things about you from insiders. Seriously....what's up? Attention to detail is critical in legal (and other) matters. 10. Yes, indeed I prefer sorting through much of that vast mass in the comfort of my home at leisure, but it must be a multistage process. There is no rational reason to move to my home (and go through) the dozens of large, empty cardboard boxes that puzzlingly took up much of the small unit. Moving it all was and is not an option for a list of eminently valid, rational reasons I'm confident you can easily discern. 11. It's curious that one would attain climate control (well, sort of) for a series of quick load n' dashes. It seemed that the climate control was to facilitate onsite sorting. 12. The increased expense is unfortunate, but when an operation such as this is executed so ham-fistedly after having more than 3 years to deal with it wisely and effectively, such is often the result. Rest assured your client is far from being a stranger to avoidable Public Storage-related fees, and that's an understatement. 13. I could write pages of relevant details, but check this gem out - pictured at the end of this email is the trash can from Dad's kitchen. He, horribly afflicted by phlegm after 60+ years of tobacco abuse, used it as a spittoon. It was placed in the smaller storage unit partially full of rather unsavory-looking and -smelling trash absent a liner bag. So, I was supposed to truck that home and mess with it was I? Seriously? That's just the tip of the iceberg. Whoever packed/coordinated this is a loon. 14. RE: the apparent lollygagging, my apologies to Public Storage and their investors, but they caused it. It was so hot - several degrees higher than outside - inside the #2133 block that evening that it badly slowed things down, resulting in a late exit. You've a valid case for a partial refund on that unit. 15. Based on your last email, we are trying to reduce the contents as much as practicable. The best outcome reasonably possible is always the goal. Again, had this not been handled so impressively poorly for years, and especially since May, a smoother ride would have resulted. 16. The effort described in #15 was successful. An additional several hundred pounds of items were removed, with substantial effort, yesterday and put into the community with lovely results, exactly how my father would have wanted. 17. I am unavailable Monday. Please release that box to Lisa Xxxxxx when she returns the keys Monday morning. I'm told the climate control at your office is fine, making prompt, complete removal likely. Good luck, From: Kimmy Wright Sent 8/15/2022, 10:46 AM Good morning. Thank you for your message. Please find attached here for your records the Receipt for the return of the Storage Unit keys and the delivery to your agent the Box of your Items exchanged in our office this morning. Round 2, dealing with my shafting in the sale of Dad's house, has commenced. To be continued:
